Fraud-Related Claims

LLFW often represents financial institutions in litigation involving allegations of fraud by bank customers, third-parties and bank employees. Those types of litigations include:

  • Claims against parties responsible for defrauding financial institutions, including customers and third-party accomplices (e.g., fraudulently obtained loans; fraud arising out of a delivery-versus-payment stock scam; check kiting schemes; forged checks).
  • Defense of claims against banks for negligence, commercial bad faith, and aiding and abetting breach of fiduciary duty and fraud (e.g., misuse of purported trust accounts; fraud by third-party investment advisors; employee embezzlement).
  • Indemnification/contribution claims by financial institutions against other responsible parties, including financial institutions, attorneys and accountants.
